How to choose a witness?
It can’t be someone who’s on the loan or owns the property. They have to be 18 or over, based in Australia and working as a (in accordance with Queensland land titles practice manual):
- Justice of the peace
- Commissioner for declarations
- Australian lawyer
- Notary public
- Licensed conveyancer from another state
- Another person approved by the Registrar of Titles.

Obligations on witnesses to Queensland property documents
According to Section 162 of the Land Title Act 1994 (Queensland) and Section 311 of the Land Act 1994 (Queensland), a person who witnesses a Queensland mortgage document must:
- take reasonable steps to verify the person’s identity;
- take reasonable steps to ensure that the person is entitled to sign the mortgage document;
- have the person sign the document in their presence;
- not be a party to the instrument or document; and
- retain a record of the witnessing, copies of the mortgage documents or evidence that they have satisfied these requirements for 7 years.
